RS should contact Brecht and the BF privately ahead of the release and ascertain the extent of any violation of agreements but I think they need to realise they cant have it on their own for ever.
People will do similar or even better things. Thats the nature of business and competition.
Clearly there is an untold story at the back of Brecht and Nostromo leaving. I am not sure they would have 'resigned for no reason' or permanently disappeared from the forums otherwise.
It is probably not a reasonable/rational explanation of events to imagine them as there to steal code...
Hopefully this matter can be dealt with keeping level heads.

We should say that Octane is based on SLG?
There are a lot of open sources for GPU rendering available for looong time it's nothing new.
Any legal problems with the blender community will be a big shot in the feet.
I'ts like comparing yafaray and V-Ray. Maxwell, Indigo and Lux. BI and Mental, Windows and Linux... no point here. All the windows users should thanks the linux community and all linux users should thanks for all the windows progress. This is what keep the wheel spinning. This is why we are not running DOS any more, this is why we all are using mice and not 3d programs based on formulas and command line. Fan-boys doesn't make any progress. I'm not talking about coping, I'm talking about make the things better and better.
So the Blender foundation should stop the Blender development so the commercial competitors will not have access to it's new features? The more blender features, more users, more professional blender gets, better for us. The more exigent users get. Better for all the CG community in general.
I'm very happy with that. I don't fell it's a menace for the RS. Octane has it's role and I'm confident that the developers of RS can make it better each time. Octane is a great piece of software. I only ask for you guys of RS to keep the focus in making it better instead of waste time, money and users with pointless legal issues and discussion.
What we are going to win if we prove that Brecht learned something as a RS coder? Enemies from the blender community? Hinder the incredible Blender progress and loss potential users? What we are going to win if RS keep making Octane way better than cycles?

leandrobp: can't you just see it's not an issue of releasing another gpu based renderer, but a renderer that's very similar in its workflow to Octane?
I think it's simply unfair if Brecht just joined RS to get as much info on new algorithms as he could (being paid during that time) and left just to share someones ideas and solutions to the "community", no matter if it's Blender Foundation or Autodesk.
These are not speculations, it really looks like he did that (at current state of events) and it would be good to hear any official explanation of this by the Blender Foundation.

I heard the same accusations on Radiance when he left Lux development. I know it's make no sense. I don't have any idea of what really happened, what ideas codes or patents are being used, but I know people are crazy to invent histories on who's making success on something. I just trust in Radiance competence and integrity (as we all can see here). And I want to trust in Brecht's and Ton's so I feel a little disappointed if these things are true.

Yes, it's looking suspicious. But let's wait and keep up creating good works as artists and developers.Just to be clear, this does not contain any code from Octane, nor does it use any company secrets. There is plenty of code out there that does GPU ray tracing, see for example SmallLuxGPU, Brigade or Optix. I'd say the techniques are quite well documented by now, there's no magical ingredient needed.
The raytracing core is based on code released by NVidia, from the paper "Understanding the Efficiency of Ray Traversal on GPUs".
