I work at a company were we are three visualisers, we always have octane daemon running (even when max is running) if someone needs to use the others gpu (if the other person is only working in the viewport for example). But if I take my colleauges gpu while my colleauge has max running his 3ds max crashes (sometimes when I turn the gpu on and sometimes when I turn it off) the samething happens when he takes mine.
We have single gpu computers with titan cards (if maybe that is the problem)

Unfortunately that's a fairly tricky to solve in software. For now you should stop the daemon, when you intend to use the GPU for yourself.
